Default do we need to get married??

Hello there,

I am a French student here in London, where I am currently finishing my PhD in Biology.
I am planning to move to the States in order to do a post-doctorate placement over there. Moving there should not be an issue for me, but my boyfriend is English (British to be more accurate), and he would like to follow me over there and find a job from there.
My question is relatively simple; can he follow me (on my visa) without the 2 of us being married? I have a feeling the answer is a straight 'no'....

sorry to say, but your feeling is right. You have to be married for him to get a visa dependant on your visa.

Correct. The United States does not allow immigration based on "registered
partnership" like a lot of European countries do.

A ring, a proposal, and vows are needed to do the trick!

In many countries (like The Netherlands) you do not have to get married for
immigration. When my current wife moved to The Netherlands in 1998, al we
had te do at the local city hall is register ourselves as living together.
This would not only enable her to immigrate to The Netherlands, it would
also give her the same rights (health insurance from my work, etc) as a
married couple.

Many countries in Europe have such an option in their legal system so that
marriage is not required. With a registered partnership however, you cannot
claim 50% of the belongings when it comes to a split between the two
persons - which is possible with a marriage, and there are some other things
you need to CLEARLY document and notarize, e.g. who gets what after you die.
With a registered parnership goods and money do not automatically transfer
to the partner, unless you have clearly stated so in a personal will. The
familiy of the deceased person will have "first rights" when a personal will
has not been notarized.

Anyway, too technical: It is an ideal "step up" if you need to do
immigration, but you are not sure yet that you want to get married or not.
The United States does not have such an option, but perhaps if Howard Dean
becomes president in 2004, he'll put a law like that in place. (Howard Dean,
Gov. of Vermont created a ligislation for legal gay partnerships in his
state and wants it Federal - yes he is running for Democratic Candidate)

BCIS also expects the marriage to have been consummated...don't forget the
important stuff...
