Divorce Certificate in Quebec(Montreal)

Default Divorce Certificate in Quebec(Montreal)

Just want to ask if any one of you guys is divorced in the province of
Quebec or been divorce in Canada. I received my Certificate of Divorce
with no seal on it just the signature of the clerk. I read the
checklist the US Consulate in Montreal and they require the seal. I
happen to get a lawyer for my divorce and he told me that the court
dont put seal on the certificate. Any input on this is much
appreciated...

Hi,

Yes, I was divorced in Quebec in 1998. Just mail in a COPY of your divorce decree as is. I didn't have a seal either and I didn't have any problems. I'm here in the states, so I guess that's good proof. :-) Be sure to include each and every page though. Don't leave any pages out otherwise you'll get a RFE from BCIS.

I also have a divorce through Quebec (many years ago) and I was just getting
ready to send them a cheque for the certified copies. So I called them. The
lady told me they do not put the seal but if I request it they will. Perhaps
if you call the court house that your divorce went through you could get the
seal.
I have included a link which will bring you to a page of all the court
houses in Quebec.

Thanks! what I mailed is the Judgment of Divorce and the Certificate.
I dont know which one is the divorce decree. My certificate of divorce
is 1 page the Judgment has 2. I send all the copy of them. So they
didnt ask you for the seal when you had your interview???

Hi Tuts

No they didn't. Actually when we sent in the paperwork, my husband, then fiance, sent in his divorce decree but he only sent in the first pages that had the divorce parts, his name, his X, place,etc, and he sent in the last pages since his divorce documents were like 40 pages long. Well, we got an RFE saying he needed to send in the whole thing. The other part of it was just the TX family code laws on child visitations. What a crock I thought, but I guess it made sense in case he was trying to hide something. I laughed at his because my divorce document was like 4 maybe 5 pages at most. But after he sent his in, we waited and waited and ooppsss we got another RFE, wanting my divorce documents. So I made a copy of what I got from the court, no seal, nothing, and sent it in and within a couple to three weeks, we got approved. I was not even aware that it had to have a seal. But they most see lots of divorce documents from all over and QC is definitely a strange one when it comes to documents. At least mine WAS in English. It could have been in French then I would have had to have it translated. Even worse. Anyway, send in copies of all pages to be safe and you'll see you'll be fine.

Thanks Kathrose! I did call them and youre right. They will put the
seal free. Im just a bit confuse between divorce decree and divorce
certificate. Is it the same or its a different thing? And also im
preparing for the interview coz the checklist states that a seal is
needed. Im not pessimistic but I hope it wont caused me RFE coz the
one i sent is a photocopy of the certificate w/o the seal. crossing my
finger... lol...

I'll keep mine crossed for you as well. Like you I don't know the difference
between a divorce decree and certificate. To me they are one and the same.
When I wrote my letter to the court house I put Certificate of Divorce as
the subject and in the letter I said final divorce decree, I also explained
why I needed it.

I must be on the right track then. Because I sent the Judgment which
is 2 pages and the certificate which is 1 page. Its really funny coz
the certificate is like a scrath paper. nothing so special, only that
the signature is in blue ink. its not printed on a letter head which
im expecting. all are just a simple computer printout. is it the same
as yours? mine is in french and i have the translation anyway. Im
expecting my 1st NOA next week. thanks!
