Divorce after refiling I-751, denial, refile

Default Divorce after refiling I-751, denial, refile

filed i-751 jointly in feb2004, i got divorced in june 2004 and the
application has been pending until last week. they denied the
application and the immigration officer told me to refile, is the
refiling useful after the first application has been already denied and
a letter of termination of conditional statues has been giving, what
would be my school and student loans situation since i have no money
and no equivlant degree in my home country.

Were you denied after an interview?

Why did you file the I-751 while you had a divorce pending? Do you think you would slip under the radar?

Yes, you have to refile an I-751 based on good faith entry into the marriage and on hardship grounds for yourself if you have to return to your own country.

Why do you have no money? Didn't you work in the US while you were married? I don't understand this at all.

the interview notice was sent to an old address with schedule date aug
3rd i never got the notice and no one in the immigration office
mentioned it to me when i was there on aug 9th with info pass to check
on the status before i travel. so the interview was never held. at the
time of filing the i-751 we were married and living toegther the
incident of divorce took place after submetting the appllication then
it was pending for 2 and half years and couldnt do anything. i have
been working 2 days a week for the past 2 years since i am a full time
student in medical technology program so i have been breaking even
every year and during marriage my wife was working part time so most of
the expenses were on my side.

Sorry about that,

I have a question, do you know why the interview letter came to the old address? Did you let CIS know when you moved? When you received your NOA for your I-751, did it come to your old address or to the new one?

well, the case was pending for 2 and half years so the noa came after a
week i did receive it, i have moved 2 times and i always called the
800# , submited an ar-11, and went to the local office. i also
informed the local office and the service senter-on phone and writing -
with the divorce issue and the case kept on pending until 2 or 3 weeks
ago

by NOA you mean the recipt notice - the letter saying they extended my
residency for a year?

To the OP:

Why did you not withdraw the original I-751 and refile it with a waiver? Was this on the advice of an attorney or just hope on your part that it would be approved out of hand without an interview?

well, no lawyer suggested the refile; same did the immigration so i
went on with my school and life thats all. i am not really into laws
and stuff so i didnt even know what to expect. how do u see the
situation now?

Since you are not into laws and stuff, maybe it might be an idea to engage a lawyer?

How can you possibly live in a foreign country and not even make the simplest of efforts to find out how to maintain your legal status in that country? For all of your education efforts, you seem pretty dense when it comes to protecting your status.

ok, i went to a alwyer and refiled I-751, is there any other steps to
be taken right now or should i just wait? thanks
