Default DCF/Marrying an Englshman

Hi!
I've been refered here by a friend and this is my first entry.

I (an American citizen) am currently living and working in London on a
Work Permit. My boyfriend (an Englishman) and I are just starting to
look into our options. We have been happily in love and dating for 3
1/2 years and are now engaged! We will be getting married here in
England and probably by the end of this year.
We would like to move back to my home town in California to
permanently reside sometime next year.
I've heard that I may be eligible for Direct Consular Filing (?) (DCF)
to get him a green card to come live with me in America. Firstly, does
anyone know if this is true and if we are eligible?
And if so, we plan on starting this filing directly after we get
married. However, we're a little hesitant to file directly after
getting married- we don't want it to look suspicious. If anyone has
any experience with this process, do you know if it matters how much
time is in between getting married and filing?

You should definately be able to file DCF as you have a non tourist visa to be here. Basically from what I understand you have to reside her and have permission to do so, ie. FLR ILR, student visa, work visa. All of these have worked before for people DCF'ing

Do a search on DCF and you should find a good deal of information here about people's experiences etc. As for filing directly after marriage, a couple on here were married on the 2nd of July, then sent off their I-130 on the 9th. They were approved w/out a hitch so I don't think the government seems to have too much of a problem w/filing directly after marriage.

Hey there

First of all CONGRATS on the engagement!
Yes you can DCF since you are living in England!!, It is the fastest way to get your fiancee in the US.. after you guys get married of course

Probably. I filed "DCF" in the UK in 2001 after having lived in London
for 3+ years on a work permit

I would guess it doesn't matter how soon after marriage you file. Make
sure your tax returns for the past 3 years are sorted out and some time
spent looking at the I-864 form wouldn't go amiss. It couldn't hurt to
have your fiance apply for his "police certificate" now unless it might
be close to a year before you can move

Your story sounds a lot like myself and my USC spouse. He had a Work Permit at the time he applied for my I-130 via DCF at the US Embassy in London. This was back in 2000.

You might find it helpful to search through my posts in this every forum under my name (I post in other forums so please check only this forum).

Also, we married in April 2000 and began the I-130 process less than 3 months after that. We had <b>no</b> problems about the short space of time between marriage and applying. No questions at all.

Ummmm... right...

Well, I just want to say thank you very much to everyone here who has
been so kind to offer me this great advice and information. It's been
very useful. So I better get to it as it appears I have a lot of
