Filing Petitions in Kuala Lumpur for Immediate relatives

The American Embassy in Kuala Lumpur accepts petitions for alien
immediate relatives of American citizens only. American citizens may
submit petitions at the Embassy for the following immediate relatives:
spouses, minor unmarried children, and parents. Fiance(e)s are not
considered immediate relatives; and fiance(e) petitions must be filed
in the United States at the nearest office of the Immigration and
Naturalization Service (INS). The approval of the petition is the
first step to receiving an immigrant visa. In order to file the
petition, both the petitioner (the U.S. Citizen) and all beneficiaries
(the immediate relatives) must submit, in person, the following
original documents to the Immigrant Visa Unit between 2.00pm and
3.30pm, on either Monday or Friday, except local and American
holidays:

• Proof of U.S. citizenship (U.S. Passport) and a
Photocopy.

• The original marriage certificate, photocopy and translation (if the
document is not in English or Bahasa Malaysia).

• Proof of termination of any previous marriages of the petitioner or
alien relative, such as original or court certified copy of divorce
decrees or death certificates.
Translations will be necessary if documents are not in
English or Bahasa Malaysia. Photocopies must be
available for our certification. They do not need to be
notarized.

• Completed petition for each alien relative (Form I-130).

• One color picture of each petitioner and alien relative. The
picture should be at least 40mm X 35 mm, showing the entire face of
the person in a ¾ face view showing right ear and left eye.

• Two biographic information forms (Form G-325A), one for the American
citizen, and one for the alien relative(s).

• The original and one photocopy of each alien relative's birth
certificate, with translation, if the document is not in English or
Bahasa Malaysia. (This will be necessary if filing for children.)

• The filing fee of US$130.00, payable in either dollars or local
currency.

Once the consular officer has approved the petition, the petitioner
should complete an Affidavit of Support (Form I-864). The document
must be notarized, and the consular officer can do so without charge.
The alien must then complete the necessary immigrant visa application
forms DS-230 Part I and II and OF-169 (These will be given to you upon
approval of Petition I-130).

Please be advised that the Malaysian Certificate of Good Conduct is
available to the public and thus applicants may apply through the
Consular Division, Malaysian Ministry of Foreign Affairs. We
encourage all applicants to contact the Immigrant Visa Unit to inquire
on the availability of police certificates from any other countries
where the applicant has resided for more than six months because it
can take several weeks or months to obtain the documents.

Completed immigrant visa application forms may be submitted in person
at the Embassy in Kuala Lumpur between 2:00 and 3:30 p.m. on Mondays
or Fridays. They may also be mailed to the Embassy. A normal
application process, from receipt of the petition to the final visa
interview, takes approximately six to eight weeks provided the
applicant has all necessary documents including the Malaysian
Certificate of Good Conduct. The application process is largely
dependent on the applicant's ability to gather the required
documentation. Applicants who have in their possession all the
necessary documents will be scheduled for the final interview at the
earliest date possible.

Before the Embassy in Kuala Lumpur can issue a visa based on a
petition filed overseas, the embassy must conduct a FBI name-check
(known as a Hawk) on behalf of the alien applicant. The Hawk
name-check takes approximately ten working days.

Once all the necessary forms and name-check are in order, a final
interview date will be scheduled for the applicant. An appointment
letter together with the necessary medical examination forms will be
forwarded to the applicant. Please note that the medical examination
should not be taken until the appointment letter is received. On the
interview day, if the applicant is found to be eligible to receive the
immigrant visa, she/he will be issued a visa the same day.

through 12.00 pm on Mondays or Fridays, except local and American
holidays and dial extensions 5056 or 2334

Documents Required for Immigrant Visa Processing

1. Immigrant Petition (Form I-130)

(a) Biographic data information sheet, Form G-325A
(b) Photograph – one for each petitioner/beneficiary
(c) Passports
(d) Birth certificate (if filing for children only)
` (e) Marriage certificate
(f) Divorce Decrees
(g) Birth certificates of unmarried children
(h) Fee – USD130.00 cash or equivalent in Ringgit

2. Application Packet for the Immigrant Visa (will be provided only
after I-130 has been approved)

(a) Affidavit of Support, Form I-864 and I-864A
(b) Copies of most recent three years federal tax returns and
statement from employer showing continuous employment
(c) Valid travel document/passport
(d) Police certificates
(e) Completed medical examination report from Embassy panel physicians
(f) Color photographs – 3 for beneficiary
(g) Fee – Application and issuance –US$335.00 or MR1273.00 – cash
only.
