Default CR-1 - Passport expiration problem

My spouse recently immigrated and we are so relieved sitting down here
in Southern California

HOWEVER - we are NOT completely out of the woods.

SCENARIO: Foreign Spouse passport expires in 2 years
PROBLEM: It's possible that his country will NOT renew this passport
***IF*** his mandatory millitary service issue does not become solved.
(There are other ways of dealing with this issue, but I'm preparing
for the worst case).

QUESTION: What will happen to the Greencard (US Residency status) if
his passport expires and unable to obtain citizenship by this time.

I would think that the greencard is like a goldcard in this
case........... but.............


Citizenship eligibility is after 3 years from AOS correct?

Hi:

An LPR does NOT need to have a home country passport.

You may want to apply for a "reetnry permit" on form I-131 to the NSC. However, if you take a look at the NSC processing time lists, you won't like what you see.

These 'white pasport' applications used to be done locally, but now they have been transferred to NSC and are severly backlogged. Lets hear it for efficiency. [For those of you who scream at how long I-129F's are taking -- just think -- NSC is screwing people who have ARRIVED and therefore have some more rights IMHO]

Expired passport will have no effect on the green card itself.

The only issue you may experience as a problem (besides travel) is that BCIS will not stamp the expired passport. Sucha a case may be: IF he's a K-1, you apply for AOS and wait adjudication and his passport expires in the meantime, he'll not get a I-551 stamp that serves as 'green card' until the plastic one arrives, or he's a conditional permanent resident now with 2-year green card and you apply for the removal of conditions, wait for more than a year and have to have passport stamped with the same stamp again.
However, if your husband already has permanent residency, dismiss the above.
