I would ad to this -- Michelle and Herb have to have a LONG talk. I've been married half my life and I know that its normal for people to keep some secrets from each other.

They had better make damn sure there is nothing, repeat nothing hidden in the closet between each other.

Every lawyer has experienced situations of surprise when something comes up and we turn to our client who then goes "oops". We have an employment case in our office where that has happened not once, but twice.

You know, I always thought that fraud would only come up when someone was getting paid to marry a foreigner. Like the lady that was married something like 27 times to guys who paid her because they wanted to get in the US and get a greencard. Just because one of them has something hidden in their past, (I mean Michelle and Herb) does that really constitute fraud?

Thanks for your post but I can assure you there is NOTHING Fraudulent about
herb nor I and I know he would never go through this process if there were !
Herb and I have talked a lot and neither of us can come up with anything
that would warrant this fraud Check!
We are a very strong couple and I have to remind you guys ....Herb is a very
good Business Man whom is in partnership with his friend and has been for
over 20 years .... www.positivechimney.com of which they are very hard
working and pay all their taxes !
I work for the Police Force here in Scotland. I am a Civilian not a Cop
but no matter I had all my Police checks done before they hired me as it is
a standard process before you can work for them. I passed them with flying
colours as I knew I would cause I have NO criminal Records or anything like
that!
We are both Law Abiding Citizens of our Countries...SO excuse me but I just
don't get it ! Why us ?????
lets hope we get happier news next week !

Michelle, I am gently treading here.....what about Herb's business
partner? Is it even *remotely* possible that his business associate has
been in trouble (even for something as minor as a traffic ticket, or
immigration issues in the USA?)

I'm trying to look at all angles of this situation and trying to come up
with some *possible* reasons BCIS is claiming fraud (doesn't mean it is
true!)

I do know that BCIS is treating marriage applications as 50% frauds of
all apps that come in. Does anyone know after Herb and Michelle are
approved, if they can file a FOIA request regarding their case?

I can't believe the number of people on this thread who think this is
all a joke---c'mon people, lighten up, this couple has serious issues
and we're trying to help them!!

Sheesh!!

Michelle that really is awful. If it hadn't been for the Congress
person's intervention I wonder when they would have got round to telling
you there were any problems.
I agree with Foly's advice to have a good old heart to heart to see if
there is anything amiss. Or maybe it is as simple as you or your partner
having the same name as someone else.
Very best of luck.

Hi Michelle:

I did not mean to suggest that there DEFINATELY WAS something about each other that you may not have known -- but that you HAD to eliminate that possiblity. When I take the gloves off on the behalf of client [e.g. thinking about litigation], the FIRST thing is to make reasonably sure that that closet is pretty clean.

Sorry you're going through all this Michelle. I had a 5 year tax investigation courtesy of a jealous ex. It turned my life upside down and all it took was one annoymous phone call to the Inland Revenue.

Maybe something similar happened with you. Of course I'm just second guessing.

One of my real fears is that my insane ex boyfriend will find out about our plans and cause problems. I've been keeping it quiet from anyone who knows him.

Hi Michelle,

I hope that nothing I said implied that I thought your case was fraudulent. That was not my intention. I am just curious what BCIS is giving you for a reason. BTW it doesn't sound like you've been given any reason at all. A lot of folks on this NG have had things come up that caused them problems, a few that come to mind...... criminal records, never met their fiance, overstays, previous K1 petitions filed, etc. But I still have not personally seen anyone mentioning an investigation for fraud. So far nobody else has posted a similar experience on this thread. It just seems very rare on this forum so we are naturally curious.

I wish you nothing but the best. Please keep us posted.

Hi:

The nature of the beast is that you will not be told the nature of the problem until they make a final decision. In fact, Michelle is ahead of the game that she was able to ascetain it was being reviewed for possible fraud. Usually, you are just told there is a "problem" which is being reviewed.
