Default Company got acquired: new H1 for travel?

Hi,

I have an H1B (sponsored by my employer, "A") valid till Sept 30, 2004.
The visa on my passport is also valid till the same date as the H1B.

I plan to travel to another country in May 2004 and return to the US in
June 2004.

My company ("A") got acquired in April 2004 by company "B". Needless to say,
we will continue to work on the same projects that we were doing before the
acquisition. Both A and B are located in the same city.

My question is: Do I need to get a new I-797 (and a new visa) sponsored
by company B in order to gain re-entry to the US upon my return from
the overseas trip?

You may or may not need a new I-797. It sounds like the old I-797 would
cover you, but much depends on the exact details of the acquisition
agreement. Your employer should hire a competent immigration attorney to
review the contracts (unfortunately, this is something that gets neglected
during many acquisitions, and later the company sometimes is unpleasantly
surprised about fines for paperwork violations).

You will *not* need a new visa, as the visa is not tied to the employer.
The employer is listed on the visa only for information purposes, but the
visa still remains valid after a change.
