Colombian wife ran off with another guy, need help!

Default Colombian wife ran off with another guy, need help!

I married a colombian woman in June, 2001. I was sending $550.00 per
month for her 2 kids and mother since she arrived. Last month I
found out she had spent the weekend at a $300.00 per night resort with
another guy, after buying two new "baby doll" outfits. I threw her
out of the house and now she's living with that guy.

She has a "Conditional Green Card" that requires us to file a petition
to adjust status this year between November and February 2004.

I now have evidence that she did not enter into the marriage in "good
faith" based upon statements she made to my friends, and one email
upon her arrival to another of her friends. We never had a joint
checking account, she kept all the money she earned at her job, and
never offered to pay any of the rent or bills.

Is there any chance that she will be disallowed to stay in the US?
What if she marries this new guy (a US Citizen) on February 22, 2004,
when the divorce becomes final?

I figured mine out in 5 weeks and sent her home :-)

They said they were "unable to adjust" but something was just wrong.

This is probably a constant danger to everyone on this group, and I would
really like to know if the marriage success/failure rate is the same as the
general population.

Hi:

Is there a chance she can stay? Yes.

What do you need help on? You don't specify. Other than the I-864, her status is no longer your problem.

If she lived with you and shared your bed, the odds are pretty good that the DHS will not be able to prove a "sham marriage" to the Immigration Court.

I have a stupid question. If she was working and not contributing any
money toward the household expenses in the US, why were you sending
money to her mother?

The statements made to your friends are going to have little value with
BCIS, since they are your friends. I would hope that BCIS wouldn't put
weight into an email as all you are producing is a easy to change page
of text, or a file, I assume. Now, if you have an email that can proved
to have been sent by here on the date you claim it was sent, that might
have some value, but that proof would have to come from the ISP.

Sure, there's a chance she can stay.
It is kind of interesting that this is not only your first post to this
newszgroup with this user name, but your first post anywhere with this

I really feel for you this type of behaviour is utterly appalling. This make us genuine couples struggle.

Hi:

There is almost nothing in the OP to suggest that they were not a "genuine couple." Immigration aside for a moment, there are quite bona fide marriages where one or both of the spouse "fool around" -- its a fertile ground for Hollywood.

Yes, you can say so but it just is a shame that SOME relationships end this way.
