Default CIA check for N400

Applied for citizenship in Nov 2002

Received email from FBI that my namecheck has finally been done.

It was initiated on Jan 21st 2003 and completed on Jan 28th 2005.

Next day after receipt of email my Senator's lawyer told me that FBI name check is done....but CIA name check is still pending.....


Applied for citizenship Nov 2002.
FP: Jan 2003
Interview: Jan 2004

I was under the impression that they do not perform CIA check for N-400 ???

But it looks like that is not true.

Hello Priyankas. I am in the same boat. I filed in September 2002, but
just got inteviewed in the beginning of this year. I heard they have
three kinds of background checks: FP, FBI, and IBIS which is a USCIS
check using their own terminals. These are good for a period of 90
days.

I read somewhere that CIA checks are done for I-485 applicants, not us.
I don't know man but my officer told me my check was still pending. The
FBI records shows it was completed back in 2002.

Do you have a lawyer? I am fed up with these people and am planning now
on filing a lawsuit. Do you have any templates for lawsuits or letters
of intent to sue?

Hi Publicus,

I do have a lawyer who says he can write letters to them, that's all. Initially when I told him about the situation, he said there seems to be a glitch somewhere but after my husband mentioned that I was told by INS officer in the interview about CIA he said OH OK it looks like then that CIA check is performed.

When my husband mentioned that we did not fill that G325 form for CIA check, he said that's not required as they can get all info needed from N-400.

He is based in NYC, and I am in NJ....he did suggest "writ of mandamus"...which would cost $3000 + becoz he would have to have to go thru another lawyer admitted in NJ.

I am looking at a list of lawyers...if you have anyone in mind...or you come across anyone let me know. Also I read on immigration.com that you could file a civil lawsuit on your own.

When I went for the interview, the lady officer told me "CIA name check" was pending, on asking how long it would take...she was sarcastic and said "I would know if I know anyone in CIA"

After that thru my repeated inquiries thru Senators office was told that "FBI background check was pending" no wherever was "CIA name check pending " mentioned.....so I was under the impression that OK I am like others stuck in "FBI name check" and that CIA check was just a "slip of tongue" by INS officer... Furthermore, everywhere I was told that "no CIA check" for N-400.

So after FBI name check was complete (according to FBI email), I thought that now get fingerprinted again and wait for Oath, but my senator's attorney calls me and says FBI name check is complete and CIA name check pending.

Also I read on this forum somebodyelse whose CIA check was pending, thats the way I reached this forum.

BTW which is your district....mine is Newark, NJ

I am actively going thru www.martinedale.com going thru backgrounds of lawyers.

Hi Priyankas:

Indeed you may file for a writ of mandamus by yourself. It's called a
pro se mandamus. Usually it's easy. You just follow the procedure used
by previous people in similar situation. The good thing about a writ of
mandamus is that you can file it within 120 days from your interview. I
can email you a case so you can get familiar with it. I am planning on
filing one myself mainly because I cannot afford an attorney now, and
also I feel better working on my case every day instead of delegating
the work to somebody else.

What kind of letters did your lawyer send to USCIS? Are they request of
status letters (which are pointless) or are they intent to sue letters
if they don't perform within a certain time? The latter are more
effective if sent to the proper authorities.

My case is with the Baltimore District Office in Maryland.

As I said before, I never heard of a CIA check performed for N-400
applicants. CIA is an oranization that deals with foreign matters, and
not domestic issues. These are under the realm of the FBI.

I heard that martinedale.com is the perfect site to check on certain
lawyers' background. But it doesn't include all lawyers.

P.S. Priyankas, what can you tell me about the G325? I filed my N-400
pursuant to the Executive Order allowing military personnel who served
during a time of war to become US citizens, and all military personnel
have to file a G325 with their application, but most of them receive
their certificate of Natz after three months of their application. So
what is this G325 for?

I think that they were just status letters....most of the work my husband has done...FOIPA request to faxing/emailing FBI.

I don't have much info about G325....as I said I put forth the question before my lawyer and he said that I don't have to fill out G325 form... even if CIA check has to be done becoz according to him all the info needed for G325 is already available with N400....
