Further development as per a member of AILA liaison -- CBP has always had the authority to note "satisfactory departure" for quite some time in regards to VWP only. Reports show that CBP at some airports will not extend stays on the white I-94's from a visa admission. They insist on an I-539 to CIS.

AILA has requested further clarification on may issues.
