Well I have a Passport with a now current I94 after using AP, but I never carry it.

I would be interested in knowing the proper answer as well.

The DL is only issued up to your status period so that should be proof by inference.

Sorry but could you please clarify: are you saying that 'aliens' are supposed to carry their passport and I-94 at ALL times?

Even during the schoolrun?!?

In the past I have travelled all over the US with just my DL...

Last time I flew I showed the DL, I had the passport just in case, not a problem.

But I think the technical answer is Yes.

Now if the I94 has expired, then what?

If the AOS receipt was good enough then say somebody who had been refused for whatever reason could use that ad infinitum.

FWIW -- INA section 264(e) [8 USC 1304(e)] states:

"Every alien, eighteen years of age and over, shall at all times cary with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d) of this section. Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or to be imprisoned not more than 30 days, or both."

Curiously, this particular act is NOT a ground of deportation [however, "wilful" failure to register or report an address change is both a crime and a deportable offense].

BTW, I have NEVER heard of a criminal prosecution for this.

For you young lovers out there, perhaps you should consider the green card [or I-94 as the case might be] to be part of your amulet to be worn around you neck at all times, lest you die -- like Ayla in Jean Auel's "Earth Children" series of novels.

In my original post on this topic, I was referencing a change in the
text of the USCIS web site.

I can't remember exactly what the web site used to say, but it was
something like: you didn't need to have the Green Card physically on
your person, you just needed to be able to present it to an officer
upon request in a reasonable time.

As of May 2nd, the text on the web site has changed, click on the link
in my first note, the text now says that in fact you must have the
actual Green Card in your physical possession at all times.

Lawyers - have you heard anything about changes to
enforcement/prosecution/etc of this provision? Or is this just a case
of clarifying policy on the web site?

Not correct, I was issued a 5 yr license by the CA DMV even though my EAD was only for a year. DMV's are notorious for issuing different licenses depending on the office you use.

I always carry my green card, it is a misdemeanor to not have it BUT I made a copy and so would use that to replace the original with USCIS if I should lose it. (i.e. apply for a new one)

If you have a car loan, the bank has your title. When you pay off the loan,
they'll send it to you.

Not necessarily true. I had the original title to my car the whole time it was being paid off. Perhaps it's different from state to state.

Hmm, I don't think that is true. I was issued my CA Driver's License
while I was still on my 12 month B-1 before I filed for AOS. The
expiration on the License is July 2008.

Yes probably different State to State here in California the bank holds it. Which my parents thought was weird. Since in Canada you get it. Since everything here including banks is different State to State this doesn't really surprise me.

to the question should i carry my greencard yes to be in the safe side because u never know what can happen to u
about the issuing of state ID's and Operating license's it depends on the state u are living most states go according to ur status and some just look if u are in status and give u a 4 year state id or operating license

Hi:

Possession of the "pink" is prima facie evidence of ownership with the right of sale! [BTW, the certificate of ownership used to look just like the annual registration card, except it was printed on pink security stock -- they have been on multi-colored paper for some time -- but they are still called "pink slips"].

I remember some years back when a friend paid off her loan and, for the first time in her life, had the actual pink. She was so excited that she intended to immediately place it in the glove compartment -- and I had to scream that she should NEVER do that -- the pink goes into the safe deposit box. My home safe has the pinks on the cars of my wife and daughters. The leasing company holds the pink on the car I drive.

p.s. I recall as a teenager that street drag races would be held "for the pink" -- somewhat like a claiming race I guess. I don't know if they do this any more.

The USCIS web site was inconsistent in this regard. Depending upon what part of the web site one looked at, there was different wording. I've reported on this numerous times and even went so far as to contact the USCIS web team to point out the inconsistency. Glad to see it was finally changed to reflect what the INA says.

I used to always carry my card - and one needed to be especially creative while taking a shower.
