Default Can someone please help me out!!!

Hi All

I have friend in Egypt who plans to bring her Egyptain husband to the
US.

1. I have informed her that the prices are going up but yet when she
contacted the US Embassy in Cario an they know nothing about it.
Kinda of puzzling to me but what she said but none the less its what
she said.

2. She also informed me that the only forms he has to fill out is the
I-130 an G325a an he DOES NOT have to any OTHER forms. Can someone
please clairify with me that Once he imnmigrates as I have told her he
will have nothing no greencard so he will have to file for the I-485
to adjust his status to get his greencard. Also they informed her she
will get a 2yr visa an get his citizenship after the 2yrs are up.
Maybe I am wrong but I thought you had to be here in the US an then
file your I-485 to adjust status an then after 3yrs if married to the
same person for the last 3yrs you can apply an over 18yrs old.

If someone could please clarify my concerns.

Is your friend a USC?

Perhaps the embassy in Cairo doesn't know for sure what happens over on the US side of things. Regardless, prices for filing forms on the US side are going up as of July 31, 2007.

If your friend is already married, they are probably doing a CR-1/IR-1 immigrant visa for him. This does NOT involve him filing an I-485 for AOS once in the USA. Once he gets his immigrant visa, he will become a Permanent Resident upon entry to the USA, and will receive his green card in the mail a few weeks later. He'll get the I-551 stamp in his passport at the POE to show he's a PR. If their marriage is less than 2 years old at the time he enters the USA, he will get a 2-year green card. If their marriage is more than 2 years old at the time he enters the USA, he will get a 10-year green card. He will be eligible for US Citizenship once he has been a PR for 3 years, has remained married to the same USC for those 3 years, and also meets a few other naturalization requirements.

Sounds like you're thinking of either the K-1 fiance visa or the K-3 spouse visa. Sounds like what she is doing is the CR-1/IR-1 spouse immigrant visa. I don't know what forms the embassy requires him to fill out, but they will send him a packet which has the forms he needs to fill out.

Yes Renee my friend is a US Citizen. I am not sure either what kind
of visa they are applying for either just told they only have to file
the I-130. With the visa you are talking about do you happen to know
how I can check how long the wait is for that kind of visa. Your help
is greatly apprecaited TY

The only thing you can check on is how long it might take the I-130 to process here in the USA. That information is at www.uscis.gov, Processing Times. There's no way of knowing how long it will take the case to get to Cairo, how long it will be processed there, and whether he'll be subject to lengthy security checks or not before the visa is issued. Offhand, from filing the I-130 to getting the visa in hand, plan on around 12 to 18 months.

Look up something called (online, not official) DCF or Direct Consular Filing. She must have been in Egypt for 6+ months in order to qualify for this.

There will be plenty of other forms.. DS-230 for him, I-864 for her (plus more).

The visa is called an Immigrant Visa (CR-1 or IR-1).

When he arrives in the US with it, he is admitted as a Permanent Resident, so he does not need to Adjust Status to Permanent Resident (I-485).
