Can a photocopy of I-94 be used while leaving the country?

Default Can a photocopy of I-94 be used while leaving the country?

Hi y'all,

My wife has to leave the country pretty soon but she only has the
photocopy of her new I-94. My old company had applied for my H1B and
my wife H4 approvals (I-797A). The company got the approvals but by
that time I had left the company. Now we just have a copy of the
approvals that were sent by the lawyer, which has I-94 attached to it.
Can she use photocopy of I-94 while leaving the country?

I'd try to get the original I-94 from the old company. If that doesn't work, you can try a copy. She should be prepared to provide evidence that she left on time, if she is asked about it in the future.

Is she planning on coming back? What is your status now? Is there a new H1 company? How long since you last had legal status?

I believe you can order a replacement I-94 from the USCIS as yo have all the details of the old one from the photocopy - check on their website. I have no idea now long it takes to come through though. I am sure you will never be able to use the photocopy.

Now that I think of it, the I-94 on her I-797 should have the same admission number as her original I-94. If she turns in the original, expired I-94, it may not make a difference.

AlisonPA is right though, you can file for a replacement.

Yes, she will be getting her H4 visa from our native country, India. I do
have my H1B approval from the new company so we are thinking of applying for
her H4 visa from India. I spoke with a lawyer and the lawyer said that as
long as the most recent I-94 hasn't expired, she is in status.

Where do we have to give the I-94 before leaving the country? As far as I
know,
an airline agent takes it before boarding an international flight. Will
photocopy be
acceptable to them? Do I need to worry about it? How can I find out from
official
sources? I may not be able get the original from my old company and I
understand
that getting a replacement I-94 from USCIS will take time.

If it's all she has, then there's no choice!

I would staple the I-94 copy to any other I-94s. She should collect
evidence to prove that she left the USA before the date on the I-94
copy - her boarding pass, credit card receipts from outside the USA,
anything else you can think of. Keep this evidence and the copy of
the I-797 for ever.
