Hello all, I just sent in the paperwork for the K3. Havent received the first NOA yet. My wife who lives in London wants to visit. Would that be possible or are there some stipulations against it?

If your wife is a UK citizen, she qualifies for visa waiver to come to visit the US. Filing a K3 means you had filed an immigration petition (I-130) for your wife. If the border inspector is made aware of the fact of the I-130 filing, it may become difficult for admission. The reason is that persions admitted to the US with tourist visa (including visa waiver) needs to demontrate he/she has no immigration intention. The key here is to convince the inspector that your wife only visits for a short time even though there is an I-130 and K3 paper pending. The best situation of course is that nobody asks about that.

Another option to look at is the DCF (Direct Consular Filing) at Loudon. That could potentially speed up the process greatly.

Hi,
I hope you don't mind me asking but I was looking for someone on this forum who is going through k3 process. I have a friend(USA) who married a guy in Turkey and now she is back here in USA. She seems to think she can travel back to Turkey in November and send application for K3 to INS and then get an interview in Turkey within three weeks. ?????? I only know about K1 fiance visa, and I just can't imagine it would all process that quickly? Any info on that? What is normal timeline for k-3 to be approved for spouse living in foreign country?

Any info with be appreciated.

I do NOT reccomend that anyone with a K-3 petition in progress have the
UK spouse visit. The immigration inspector may think the spouse will
just up and stay, and remember, the inspector has the final say about
admission. The K-3 filing WILL show up when the passport is swiped thru
the machine.

I am in K-3 process now with my husband Ken. This is the advice of my
legal representation. They say that BCIS estimates that 50% of all
marriage applications are frauds and they are checking very carefully.

Even if you have what is a "straightforward" case (there is another USC
with a UK husband on this board that has one---sorry can't remember your
names!), it is NOT WORTH IT to tempt fate. If you can afford it, go over
there.
