Default Can British husband be turned down for spousal visa

Thanks for the info on the visa I appreciate it. Now I have one more
question I would like to add. Can he be turned down for the spouse
visa even if he has all the paperwork in order, etc...marriage
license,photos of wedding and such as that? And how long would it take
to get it approved so He could come here. If it was to take to long I
would consider moving my family to him and live in the UK.

There are no guarantees that a USC's foreign spouse will be approved for a spousal visa. There are criteria that he has to meet and if not met would mean that he would be denied. Some of those would be health issues, criminal history, visa overstay in the past, fraudualent statements and/or information given at any time to the dept of state or dept of justice, lack of financial sponsorship, etc.

Being he is from the UK it would be easier if you and your family got leave to remain with him in the UK to reside. Once you have said legal right bestowed on you by the British Government you can, after a short time, apply for his entrance into the US as a resident directly through the US Consulate, thus by passing USCIS entirely. Of course, the same criteria for denial exists. The timeframe for this (DCF) is usually 3 to 4 months from start to finish and allows you to remain with him during the processing.
