CA DMV and K-1 Visa
 
I just took my wife to the CA DMV. Her K-1 visa expires on May 11, so
the person at the DMV told us she could not apply for the driver's
license because her visa expires in less than a month.

We have already done the biometrics are awaiting another letter from
immigration for the next step (an interview, I think). It is
interesting that the government has yet to bank the two checks I sent
paying the adjustment of status, biometrics, and work permission fees.

Anyway, doesn anybody know if the DMV clerk was correct, or should we
go back with the approval letter from immigration and try again? Thanks!

Look on their web site, most DMV's require EAD, but each does as it pleases.

CA requires neither EAD (or SSN) - though they can be difficult and/or clueless.

The letter should be sufficient. Insist on speaking to a supervisor if necessary. Or go to a different office. Call the Central # as a last resort - that's what I did and they sorted it.

At the very least they should give her an interim/temporary DL.

I came in on a K1 (Los Angeles). All the DMV asked to see when I applied for my driving licence was my passport and Social Security card. It was before we were married and applied for AOS.

Do you happen to know if the interview is the next step after the
biometrics? How long until my wife gets permission to work? Thanks!

Yes, after the biometrics for the AOS (all 10 fingerprints), you just wait until you get an interview appointment letter in the mail. You can check processing times for your area at www.uscis.gov to get a rough idea when you might get an interview.

The EAD (permission to work) can take up to the full 90 days. If 90 days goes by and she hasn't gotten the EAD yet (some people don't even get the biometrics appointment by then!), make an Infopass to do an inquiry in person.

Thank you, I think this is what I'll try next. I've searched and
searched the CA DMV website and I can't find anything about driver's
licenses and visas.

IMHO it really depends on who you get at the DMV. Knowledge and enforcement of their own rules is spotty at best.

Print out the proof of legal presence docs from the CA DMV website. Make sure you have the appropriate item(s) from the list. Then go down to the DMV and try again.

Things that may help:
1) keep asking for a supervisor to explain why they are not complying with their own published rules, until someone tells you yes.
2) try a different (smaller) DMV branch, even if it means driving farther or going to Mammoth for a long weekend.

If it's not worth the aggravation, just wait till your wife gets her EAD. They'll accept that for sure.

Sounds about right - I did Fremont DMV, K1. Got the license a couple of
weeks after I got the SS, as I recall..

I arrived on a K1 Visa which "expires" once you have used it! It is only good for a single entry. The Visa conditions are that having enterred the US you marry within 90 days. I don't understand when you say you only have one month left on the Visa!

Anyway, I went to the DMV 1 week after arriving, registerred to take both written and practical tests. All they wanted was to see the I-94 (I think thats the number). I did not have a SSN or a EAD.
