Bringing Tax Documents to AOS Interview
Hello all,
My wife and I have started collecting the documents for our upcoming AOS interview. In the interview notice, it asks us to bring our tax filings and W-2s for the last 3 years. We have already filed our taxes (jointly) for 2004 which means we need to bring 2002, 2003 and 2004. But given that we made the AOS application in October 2004, should we also bring the 2001 tax documents (counting 3 years back from the application date)?
I know it would be safer to bring the 2001s anyway but I can't find my 2001 state taxes. If the answer is yes to the above question - is there a way to get your tax documents from the state Department of Revenue?

If you go to the IRS office that serves your area, you can request a
digest of your last 3 tax returns. It is exactly what USCIS wants to see.
It shows that you filed, and it showed your taxable income.
Best of all, this digest is free. Just show up, do whatever they tell you
to do to request it, and come back when they tell you to claim the papers.

We filed for AOS in October 2004 and just had our interview in February 2005. We were asked for the 2004 tax returns but I told her I hadn't filed them yet as it was only February. She took the 2002 and 2003 transcripts and the 2004 W2's. She also asked for a new affidavit of support.
The last 3 years you've filed for are 2002-2004. I don't see why you'd need the 2001 as well. I'd bring transcripts for those 3 years as well as an updated affidavit (notarized again-some people think they don't have to get the new one notarized, I don't know why).

It wouldn't hurt to bring your 2001 tax return, just in case. You only need
the federal ones, not the state ones. So don't worry about that.

Thanks for all the answers. I didn't realize you only need the federal returns. That's a big relief!

My wife and I are preparing for her AOS interview next week. After seeing your post, I went back to read the letter we received for the interview but didn't see we need another affidavit. Does your letter specifically call it out or it's implied and we missed it? Thank you in adv.

No, this doesn't sound right to me, though I don't have my AOS appointment letter in front of me. What is required, IIRC, is a notarised affidavit, only if one has not previously been submitted with the I-485, but an updated letter from the employer of the sponsoring party stating that they are still employed, and the present income is required.

My wife and I had our AOS interview about a month ago. We were not asked
for a new affidavit of support. But we had one ready, just in case.

I think they basically want to verify your income. The federal returns are
enough to do that. And if you think about it, it makes more sense to use
the federal ones. That way, all USCIS offices all over the country only
have to know how to read one kind of tax return. Instead of being faced
with a possible 50 different state types.
