Both I-130 and I-129F

Default Both I-130 and I-129F

Hello,
I filed the I-130 in May, accepted and is now being processed. I sent in the
fee for the Affadavit of Support papers, and extra $15 to send overnight
delivery to get them quicker, but haven' t got them yet, and my husband has
not received any of his forms yet. After talking to the embassy in Egypt,
that is where my husband is, they told me to file the I-129F petition for
fiance (spouse), to expediate the process, I did this and got a receipt
number end of July, as of now I haven't got a case number for this yet. My
question is can we use both to see which is faster to get him here and then
finish the wait for the I-130 here or cancel the I-129F and how to do this,
and would suck cause would lose the $170 that I already paid. There ought
to be a faster way to do this, I was counting on him being home for the
holidays but it doesn't look like it.

I doubt he will be here in the US for the holidays. The I-130 and/or the I-129 for the K-3 will take at least another 3 months or longer for processing. The USCIS/National Visa Center will not send you the paperwork regardless of your having sent overnight postage/mailing envelope prepaid. You will receive it via regular mail. It appears to be their polidy that it has to be mailed in their envelope.

The biggest hold up for your husband will be the getting the security check completed. Egypt is one of the countries where they are experiencing long delays in running the FBI, CIA, IBIS and whatever else there is name and sometimes fingerprint clearance. In addition if he has lived outside of Egypt in any country that issues police clearance he will need that from that country as well.

Hi Mare,

In addition to what Rete said, which I agree with, the answer to your question is yes, you can following the 2 paths (I-130 and I-129F) and see which one happens quicker. Whichever one happens first, bring him here that way. However, you will not get a refund for the money you paid for the route which was slower.

You are doing everything the best and fastest way already. As Rete said, the biggest holdup will be his security checks, and there's no predicting how long that will take. I also agree he probably won't be here for the holidays, sorry to say.
