Born in US to Indian Parents
I'm on a H1 Visa. I will be returning to India permanently in a couple of months. My
son was born in US this year. will my son lose his US citizenship? can i apply for
indian PP? what should i do to retain his US PP and maintain his US citizenship? can
anybody pls. help me in providing answers?

Hi Ravi: You can apply for a US passport for your son with his birth certificate at
your nearest municipality office. Do it soon as it takes a few weeks for processing.
Technically, you should be able to get him a US Passport even in India using the
birth certificate. If you get him a US passport now, you will need a visa stamp for
his entry to India. In general, it is very hard to lose US citizenship if born on US
soil as per current laws. Of course, hard to predict the future! Good luck.

Your son will always be a US citizen, unless he renounces it, which he can't do
legally till after age 18. It doesn't matter how long he's away. My brother was born
here, and was in my parents' home country for 16yrs, without ever coming here and
he's okay. You can even get a US passport for him, and keep renewing it at the
American embassy in India. Or he can get one whenever there. No need to worry, you
don't need to do anything. The US govt will always see him as a natural born US
citizen, regardless of if he's here or in India!!
