Apply in London before moving?
Hi All,
I have accepted a position in Texas and will be relocating in two months. I'm trying to decide which is better because once I move I will no longer be resident in the UK. My husband (British citizen) will remain here in the UK.
Option 1 - Submit the I-130 now two months before I depart. Will there be any issues with me leaving and becoming non-resident after the submission?
Option 2 - Wait until I establish residency in Texas and the file the petition.
I (the petitioner) have dual US/UK citizenship.
My husband is a British Citizen.
We have both been resident in the UK for six years now.
Any issues with option 1?

It will be quicker to file now using the DCF (Direct Consular Filing) method. This is only open to married couples that both reside in the UK legally. Once submitted you can then leave the country and establish your new life in the USA.
