Default AOS Questions

Hello all,

I'm filling out the required documents for AOS after entering on a K-1.

If anyone could help out with answers to these it would be appreciated. I've done some searches, but nothing obvious has come up.
  1. How recent do the I-864 documents need to be? I have a letter from my co-sponsor's employer (if he is needed), but it's dated May 2016. Not sure if I need to get a new one or not.
  2. My wife has only been working for about 4 months (recent grad). She greatly exceeds the poverty line, but unsure if we need a co-sponsor as it's a new job? We do have a co-sponsor if needs be.

Generally, evidence is valid for a year. You can bring an updated I-864 to your interview if you want.


She greatly exceeds the poverty line, but unsure if we need a co-sponsor as it's a new job?
It's good to have a joint sponsor (not co-sponsor) in your back pocket, but only use him if you need to. Current income is always more important than past income, so she can complete a new I-864 prior to your interview.

I do have another question, regarding sponsor's household size, would that be the current number or that of the previous year's tax return?
