AOS Question
Ok I have printed out all the forms for AOS but i have a couple of
questions please.
First one may sound stupid but i am honestly not sure what to do.
All the forms ask for my family name...is this my married name now or
my maiden name??
2) In the package i printed out from INS website it included a I-130
Petition for alien reltaive. Since we already did this i am assuming i
dont have to do it again, that i just enclose the Notice of approval?
Is this right or do we refile this petition also?
3) One check for both the INS processing fee and fingerprinting fee or
two checks?
thanks

Our lawyer used my new married name on all of our forms, there is a place for other names used and I noticed she put my maiden name there.
I think it's up to you.
Have you changed it at social security yet? That should be your first step.
Good luck to you, and congrats on your marriage!

But it's not a pre-requisite. In fact a number of offices wouldn't allow the
immigrant to change their name until they had an EAD and wouldn't allow the
change of name to be to anything other than what's on the EAD. So, use the
married name on all forms to the INS and tidy other things up later.
(In our case we had a wonderful day - morning filing with the INS, afternoon
at the SSA and the DMV; my wife is the US citizen but that doesn't really
change anything).

I should have said that I am the USC and my husband is from Germany so I used his last name on my forms.
It's not clear in the first post who is the immigrant your husband or you, my answer only applies if your husband is the immigrant.
Sorry for any confusion.
