Default AOS as I feared...

We will be late filing it... the big move to montana is coming in 16 days... were filing Aug 3rd, his visa expires July 21st... this isnt going to cause major drama in the long run is it?


Could I send in the papers early and inadvertently forget the check? lol jks

pss do i have to fill out g325a again as i did for the petition? thanks again!

It doesn't matter if you are a bit late to file. However, if your spouse entered with the visa waiver then late filing is riskier.

Fortunately, Agent's fiance arrived on a K-1 and they got married within the 90 days. It's OK to file the AOS a bit late.

Agent...The USC does not need to do another G-325A, but the immigrant does.
