Default AOS & Driving License

Hi

Once i have filed all my various paperwork for AOS - will i be able to apply for a US driving license? What would i need to show to prove i live here?

Each State has its own rules so look on the local DMV web site.

Usually you need EAD to obtain a US license.

What's needed for a driver License depends on what state you live in. Most states have web sites with this information.

Ditto what the others have said. You'll have to check with your particular state DMV. Usually, once you have filed AOS, you will need your EAD to show them. That's how it was here in Arizona.

An unexpired I-94 can also be used as proof of residence to apply for a license (in New Jersey, not sure about which other states will accept it). But once the I-94 expires you have to wait for the EAD.

I think they also need a valid social security number in NJ, so that woule imply EAD is necessary. It might be possible to get the number that isn't valid for work though (can't remember what they call them).

Yes, a SSN is necessary. But K1's can get a SSN (valid for work only with permission from DHS) straight away. You still need an EAD to work, but it's still a valid SSN as far as NJ MVC are concerned.

Hi

No im not a K1 - i was on a B2 and got married, so filing for AOS at the moment. My I94 is valid til beginning of Nov, so I can get a driving license valid til then - but will i then be no longer able to drive?

Can i show that i am going to be AOS to get a longer driving license?

Probably not

But probably can use you non US license.

Again, it depends on which state you are in. But an I-94 on a tourist visa will probably not be enough, even if you are applying for AOS. Best bet is to wait for the EAD

You can get a DL on an I-94 in Florida but the licence will only be valid until the I-94 expires

So once my I94 expires i am no longer able to drive until my EAD is approved?? There's no other way, or anything else I can show them to keep the license valid?

How long can i drive on my UK license?

I am shocked i will be unable to drive!

That only applies to Florida ..i don't know what State your in ...

In Arizona, DMV first used the expriation date on my husband's I-94 (90 days). After 90 days, his EAD had not arrived yet, so DMV used the expiration of the actual K-1 visa, even though the visa had been used already to enter the USA (another 90 days). After that, he had his EAD so DMV used the expiration of the EAD (1 year). After that, he got a renewed EAD, so DMV used the expiration on that one (1 more year). Now, he has his 2-year conditional GC...I supposed in a year when we go in, DMV will use the expiration of that (making it valid 1 more year). Next, he will get his 10-year card, and finally can get an Arizona ID valid for 10 whole years. LOL

He hasn't been able to get his license yet due to language issues.

You can try taking all your documents to DMV and explain your situation...maybe they'll do like ours did, and use the expiration of some other document until your EAD comes.
