AOS before EAD?

JAVI is an unknown quantity at this point

AOS before EAD?

I was fingerprinted and pic was taken for EAD latter part of August 2004. However, I did not process AOS and waiting on I-130 instead. Have not received EAD yet. Someone told me I won't get EAD until I file for AOS first. Got here via K-3. Please let me know.

Javi,

A K3 does not need to apply for adjustment of status in order to get employment authorization.

thanks kindly Jeff - what a relief - was about to panick. It's going to be about 80 days since fingerprinting for EAD. I guess it takes a while longer. Any idea when I should I start worrying?

If you don't get your card by the 91st day after the NOA received date, you can go in person and get an interim EAD in the meantime.
