Anything I can do to chase up EAD? It's been 104 days.

Hi all,

Submitted my AoS back in March, had one issue with I765 (i stupidity missed a signature and had it returned). I resubmitted, and the receipt date was April 14th. 104 days later I've not received it, and my online status shows no further updates.

I received my AP fairly quickly, but nothing since.

I'm in a tight spot, my job situation has somewhat changed recently, and long story short i'm significantly worse off financially. I need a new job, and have started to look into options, but as best I know, I am stuck on my work visa until I receive my EAD.

Is there anything I can do to have my case looked at?

After 75 days you are allowed to enquire:

Also, check out this useful post:http://britishexpats.com/forum/marri...cation-892309/

Thank you.. I will look into the enquiry. I don't have an alternate job yet, so the second route probably isn't really suitable for yet (though i am looking so maybe if something comes up).

As for the enquiry, does this typically yield results? Speed anything up? or is it more a "find out where I'm at" kinda thing?

Thanks, helpful response.

You have the read to the sheet for yourself. It might hold it up but then again it won't expedite it but it might grease the wheels a bit. The length of time for an EAD has seen varying timelines over the last 5 months. It varies from receiving it within 2 months and then again others have taken 120 days or so.

In your instance you had an initial request for more evidence, i.e. signing the document. So, of course, as the sheet states, and you already know, the timeline restarted from the date the evidence was returned.

If it were me, I would go for calling the 800 number and putting in an inquiry as to the status. What really do you have to lose but time. You can still job search, just not accept anything until you have the EAD.

Once you have an RFE, the 90-day timeline goes away and it takes as long as it takes. That said, I've read posts where others have been successful expediting the EAD either through Infopass or contacting their Congressman.

did not know that.. although mine wasnt so much an RFE, it was totally rejected. I submitted the EAD all over again. Don't know if that makes a difference..

Well if anything I would assume that a completely resubmitted EAD would be at the back of the queue.

I actually called and raised a service request on mine instead of filling out the web form, it arrived a week later.

Even with a receipt date of the re-submitted form of April 14th, still well over 75 days. Worth calling in about for sure.

We applied for our EADs in mid December last year (Employment based AOS) my son had his EAD in hand in 69 days, I had mine in 74 days, my husband's (the principal applicant) took 127 days. No rhyme nor reason to USCIS timescales.

We had a trip planned and my EAD/AP card had not arrived, so my husband called his local Congressman's office. They asked for the application info and they had it approved within 3 days.
