Is age an issue for K1 applications?
Hi,
I have been lurking in this group for some time, following the courses
of people through the K1/K3 visa process and being so impressed and
moved sometimes by people stories and by the love and support that so
many here give others going through the process. I've been on usenet
for over 15 years but this group is the most friendly and
non-confrontational I have seen - the a-hole count is extremely low,
especially for usenet!
Well it will soon be time for my fiancee and I to walk the walk. I am
just waiting for my Decree Absolute to come through and then we start
the process. I am going to stay with her at the end of the month (She
is American, I am British) for a couple of weeks and although it will
mean another tearful goodbye at Newark come July 12th, knowing that it
will be for the last time is really heartening.
Anyway, one thing that never seems to get much of a mention in this
hroup is the issue of age. Both my fiancee and myself are 49 and I was
wondering whether that would be taken into account when we apply? I am
healthy - not exactly as fit as I should be but I have no diseases,
disabilities or aversions to hard work but I just have a couple of
concerns....
1) Will age and fitness be taken into account at the medical?
2) Is age taken into account when deciding whether a visa can be
granted?
3) I have been treated in the past for bouts of depression but nothing
for years and nothing which incapacitated me, would this be an issue?
Sorry for all the questions but I couldn't find the answers to these
particular ones on the websites.
Thanks for your help and good luck to all those missing their loved
ones and praying that their journey will have a happy ending.
Dave

Hi Dave,
I wouldn't worry about it if I were you. I was 52 when my K1 Visa was
issued in October 2001.

Dave,
The issue of age is not mentioned because it is not an issue.
Age and health are two different things. There are medical conditions that will make one ineligible to immigrate. Growing old - which you haven't done yet - isn't one of them.

"Concerning depression: having depression does not mean that you flunk this test...there are many people who have this medical problem who have passed the medical exam. A primary concern would be whether the disease was being treated successfully and the person was FUNCTIONAL...that is, stable and able to work. Another consideration regarding mental disorders would be whether the person was having problems currently with psychoses, as these would be disabling and possibly require institutionalization, or might be a threat to himself or others. If there was no psychosis, then you would have a good chance of passing the exam. Mental and mood disorders do not automatically mean you flunk the exam. Again, physician documentation regarding the problem, it's treatment, and the success of that treatment could be very important."

Good luck!

I wish I was 49! ..........lol I am 61, came to the USA on a K1 in December 2002, and have had no problems on the age score. I have the impression that, if anything, a certain amount of ripeness in years may actually help you through the process to some extent. After all, uprooting yourself at a more advanced age is not likely to be a whim!

Re: Is age an issue for K1 applications?
Thank you all for your responses. It's surprising to find that I am
actually a youngster here - I love it! It is very good news to hear
that age is not an issue regarding the K1 visa so that reduces the
worry level quite a lot.
Thanks also to Debbie for the medical link - that is very useful
Debbie.
Apologies for not replying sooner but my home ISP's mail server has
decided that it's not accepting SMTP mail for the time being. Ho-hum.
