Affidivat of Support - AOS
Hi All,
My last year tax return income was $ 12K and the 125% poverty level requirement is $
22K. I'm SHORT by 10K. Can i use my foreign spouse cash bank balance for the
difference for the 10K ???
We are staying in the same household for 3 months and her I94 expires in 3 weeks !!

You must either have a large family or live in Alaska/Hawaii?

That is a 100 percent chart.
If the sponsor is not in the military, the requiremnt is 125 percent of
those amounts. So, 22K would cover about 3 people in AK and HI, or 4 in
the other 48. Not really a "large family"
For the OP, if the assets were counted, you would need $50000 in asset
equity to cover a $10000 shortage.

Holy #%&@! I messed up our Affidavit!! When we applied I used that chart and at the time INS.gov doesn't have that 2002 poverty guideline link to the form page. I've read it again and again and went through that form many times more than I could remember.
Not only did we use 2001 poverty to match with 2001 tax return, we also used 100% number, while checked the box for 125%. #%#&!!!!!
I guess I have to contact INS and see if they want us to re-submit affidavit to correct the 125% number although USC 1040 is significantly above the required amount.
