Affidavit of support question...
 
I had submitted I-864 as a joint sponsor for my brother's wife. We got a letter from NVC saying to fill out a new I-864 and send the missing documents with it:
Missing document is that there no employment letter attached my brother's I-864.... I attached mine with my -864 and thought he didnt need one since I was the one with sponsoring income.....

Now what do I have to do.. do we have to fill only I-864 for my brother and attach the employment letter or do i have to fill the joint sponsor form again as well?
Also do I have to attach all my tax return transcripts as well? since i dont have a copy and i would have to order new ones, i wanted to now if i really have to do that....

Hi Sanna,

If all they are asking for is a letter from your brother's employer, that's all I would include in your return envelope. If your brother is not working, have him write a letter explaining that he is unemployed and cannot provide an employment letter, and to note the existence of his joint sponsor who meets the qualifications.

thats would have been simple... but the letter s also saying to go to the website and print an I-864 and send that with the employment letter... thats where i am confused now if he is sending I-864 then does he have to send everything else with it as well?

Yes, your brother is still the "main" sponsor, with you as a joint sponsor. Your brother needs to send an original I-864, plus whatever backup goes with the I-864, even if he doesn't qualify financially. That includes a letter from employer (if he's working), a couple of pay stubs (if he's working), his latest tax return (if he filed one), and perhaps his most recent bank statement.

If he doesn't have any of those backup items, he needs to write an explanation as to why he does not.

Thanks Noorah for your quick response :)
but i am still confused. we did send everything for him his I-864 and annd the required documents except his job letter.... now when they are requesting the job letter with i-864.... does he have to send everything again or just the i-864 and the job letter.. since they already have his tax returns etc....?

Well, again, my advice is to only send what they ask for. If they are asking for an employment letter AND a new I-864, then do that.

Just state in a short cover letter that you are returning the items requested, to support the other evidence which has already been submitted.
