affidavit of support question!!
My husband and I are in the final stages of his immigration, he already has
his k-3 and we are currently waiting for his EAD card. My question is this:
I have heard mention on this board of people using the wages of the
immigrating party to qualify for 125% of the poverty guidelines. Is this
possible?? Meaning, once my husband has a job and we decide to do the
adjustment of status, can we use his wages as well as my own to meet the
minimum?? I already have a co-sponsor lined up, but if we can just use our
combined wages that would be wicked.

yes it is possible to use the immigrant's income for the affidavit of
support, providing the immigrant has lived in your household for a minimum
of 6 months and files an I-864A along with your I-864. This is how we were
able to successfully adjust status, as shortly after we got married, my
husband lost his job and we began living on my income alone...we filed the
I-864 showing the total household income including my own, along with a
current employment letter and pay stubs from my job and our joint tax
returns from last year.
