Affidavit of Support for non-sponsor

Hi,
My dad sponsored his sister to come to the USA 12 years old. He just received the Affidavit of Support form from INS now. Since he is retired and does not want to risk his assets, can his brother (my younger uncle) do the Affidavit of Support instead of him. The form said the sponsor has to fill it out. If he is not eligible, then he can get a co-sponsor. The sister is 60 years old and the form said the sponsor has to support her for 40 quarters (10 years). If she gets ill and needs to go to nursing home, I believe the sponsor has to pay for the nursing care. However, my uncle still want to sponsor her.

No. The brother can file an I-864 as a joint sponsor, in *addition* to your
dad, but your dad, as the petitioner, *must* file an I-864. This would be
true even if the petitioner did not possess the income and assets to satisfy
the public charge requirements.
I think there is an exception if he actually dies before the beneficiary
immigrates.

Yes, he can get a joint sponsor, but he still has to file the I-864!

If your dad trusts your uncle, there should be no problem.
