Affidavit of Support for K1 Fiancee visa
Hi everyone,
I am the fiance of an American student, I am currently living in England. We
almost got all our paperwork together to send in, when I read something
about the Affidavit of Support.
She is in the final year of her degree, and works 2 jobs. But I don't think
she will be able on paper to be my financial sponsor. I think her gross
income for the year would no more than $12,000 U.S. a year. Does anyone know
what the accepted minimum salary currently?
To further confuse you all, my parents are currently working / living in the
U.S. I'd like to use by dad as the sponsor, but he is only on a 2 year work
visa that is renewed every 2 years. From what i've read he needs to be
either a U.S. citizen or hold a greencard right?

Also do you know if you can have a financial sponsor that isn't a U.S.
citizen or greencard holder?

Bear in mind you need 125% of those guidelines - which is where the $15150 comes from - unless you're in Alaska or Hawaii where the ceiling is higher.
A sponsor has to be a United States Citizen or Legal Permanent Resident. You do need to show the last 3 years' tax returns but the main thing you have to prove is you are making enough money now. The fact that he might have made it in the last two years is unlikely to get you through. Sounds like you will need someone in the US to act as co or joint sponsor with you.

From my knowledge, only one year's tax return is requested for the I-134. After you get married and file adjustment of status (AOS), you will need 3 tax returns for the I-824.
Does she have assests? More than $15,750? If so, you will meet the 1-134 standards. The idea is that she needs to earn either $15150 a year, have about $75000 in assests (5 x 15150), OR you can compute assests and salary together (since she makes $12000 a year, subtract her salary from 125% of the poverty limit salary ($15150)= $3150 then times that # by 5. = $ 15,750. This is the required amount of assests for her salary level. )
If she can't do this but you have money, check out the London embassy website, the I-134 information page, and find out how you may be able to use your own assests. email them with questions.

I've been going through a very similar situation, I'm a graduating student (summer school is over in a week--then I'm done!), and money is nearly too tight, but we will be fine (fingers crossed)....our interview is soon.
btw, her level of education (your's too) might be taken into consideration as well.

Not all 3 need to show the 125% of poverty income, not even the last one. Proof of *current* income at 125% *is* required.
As Folinskyinla likes to say, don't conflate the two.
If her income is 'close', she can use assets to make up the difference, at a rate of 5 to 1.
