Default Affidavit Of Support -- do I need to wait for the real W-2?

It appears that I will be DCF'ing for my new husband as we have decided that he is going home today (he's already on the plane).

I want to go over and file paperwork as soon as I possibly can. However, the most recent tax year is 2005 and my employer is refusing to provide me a W-2 until Jan 31st (which is their legal right).

I know how much money I made and can do a preliminary tax return based upon those numbers. I have my year-end pay stub. Do I have to wait for the W-2?

Or, since you're not required to file 2005 taxes until April, you could use 2004 taxes which you already have. In your case, right now, 2004 IS the most recent tax year.
