Affidavit Support Dilema, help please...
My wife: age: 23. US citizen but lived in venezuela the whole time,
except childhood...
Me: age: 27. Venezuelan, married her six months ago...
We both live in Venezuela, she has a job opportunity in US, we are
about to file and submit i130 through DCF (Direct Consular Filing)
here in Venezuela, cause we´ve heard it is the fastest way... so our
dilema is the following:
Does venezuela truly allow DCF?... some say yes, some web sites say
no... so who´s telling the truth?... hint: she went to US embassy in
venezuela and they gave her the i130... does that mean they allow
DCF?...
if that´s positive... DCF OK... our economic situation at this moment
isn´t the best right now and she really need to work in US to afford
my sponsorship... we haven´t found a co-sponsor so she´ll be my
affidavit support...
Can she file and submit i130 through DCF here in Venezuela an then go
to work to US in order to gain some record to be able to be my
affidavit support?... can she file the i864 in US after filling i130
in venezuela...
can she file the i864 just after getting the job in US?
can any body explain me in more detail the whole process, pros, cons,
of filling through DCF... how long does i take?, and tell us some
affidavit support tips?
must we still file de K3?...
Help...
except childhood...

By regulation, ALL immigrant visa issuing consulates allow DCF for petitioners RESIDENT in the jurisdiction. However, some consulate extend the practice to petitioners merely PRESENT in the jurisidction without being resident. Quite often, when people talk about "DCF" they have the second situation in mind. You fall in the first, so you CAN do DCF.
For the I-864, you will have to establish that your spouse will be taking up residence BEFORE or CONCURRENTLY with you. On the finances, you may need a co-sponsor.

Re: Affidavit Support Dilema, help please...
ok thanks, that answers our dilema... but what´s the difference
between normal filing and DFC?... how faster is DFC in comparison to
the "standard way" (i130 - k3)?... any records?
In the other hand, we are very nervous about the whole thing, we are a
very in love couple and our marriage is pure and legal.... but besides
that... is there a posibility to be worried about of being denied?...
is there a chance they reject our petition?... what chances are?...
any sad ending?...

Re: Affidavit Support Dilema, help please...
In general the DFC is fastest folowed by the k3 and I-130. (You have to file
the I-130 to start the k3 process). DCF is typically a couple of months,
while a K3 is taking 6-9 months for many of the people on this list.
The DFC is not available to everyone. The rules depends the Country you are
in. The speed of the K3 and I-130 process is generally dependant on where
the USC is a resident. (See www.immigration.com for time frames for
different types of visas at the different service centers.
Rejections are most likely if you are from a country where there has been a
lot of marriage fraud or if the spose has a record.
