Affidavit of Support Advice - UKC will be primary support

I am a USC, now dual citizen, living in the UK for the past 20 years. We have filed an I-130 with the London Embassy so that we (my husband, a UKC, and our daughter, also dual citizen) can move to be near my family.

My question is regarding the Affidavit of Support because my husband will continue in his current work with the same company in the US, as he works from home and can work anywhere in the world. His company have confirmed that they are happy for us to make the move and he will continue on the same salary. I am currently employed but not sure if I will continue to work when we move. What would be the implications and/or how do we address the support issue?

My parents are more than happy to be co-sponsors if required, but it is our hope that we can do this on our own.

Any advice or experience in this situation would be much appreciated!

If your husband earns at or above the 125% poverty level (see form I-864P) for the 3 of you, then so long as his income will continue from the same source, it can be used on the I-864 Affidavit of Support and you will not need a joint sponsor (not co-sponsor).

Have you been filing your US tax returns annually? If not, you'll need to file at least the most recent 3 years' worth.

As Ian says, as long as he earns above the required income level, his income can be included on your I -864. He doesn't need to do an I -864a. He should provide proof that his income will continue from the same source.

Thank you very much for your replies. My husband has been worried about this so it's good to know. I will be spending tomorrow getting up to date with my tax returns!
