advice please- husbands interview is thursday. He overstayed....
I was wondering if anyone had any last minute advice...
My husband's interivew (K3) is thursday in Cyprus. He had overstayed for over 180 days, and left the US on his own.

I'm sorry, I don't have any experience in this area.. but you must be anxious. What advice have you received so far regarding the overstay ban? Do you expect him to receive the ban and then appeal or is there some discretion in the imposition of the penalty?

I am facing a similar situation. I am in Denmark married to a US Citizen,
and we have filed with the Consulate in Copenhagen. However, I am facing the
10 year bar from a 1+yr overstay. The consulate will not make a decision on
the information until it is processed.
My final interview is on Feb. 6 and I am anxious about it as well, but if I
am turned down I am going to try the waiver of excludability. First it is up
to the consular officer to make the decision about issuing the visa, so I am
keeping up faith, since I don't have a record of removal proceedings,
deportation or denied entry. I too left the US on my own accord after my
unlawful presence.
Please post the interview experience,

My heart goes out to you both. Sounds like we are in the same boat. Do you think there is a chance at all of the interviewer being completely aware of an overstay as long as ours and still granting us the visa anyway?
I'm trying to stay positive, but I think that it is the law...and even if my husband is completely honest and sincere in the interview, he still will be denied.

I do not think you can expect "discretion" in this matter. They operate
on law, and the law says that you get a ban for an overstay. 3 years for
180 days or more, 10 years for 1 year or more. But they should offer the
waiver option.

Hi guys. Im in the same situation, Im applying for my husband who overstayed cuz he was technically "out of status". but when he left on his own, there was no overstay stamp on his passport, and we were married b4 his visa expired. I dont know if he will be denied but we hired a lawyer in case.
