My fiancee is a USC and i am a UKC. She is currently living in the uk on a student visa whilst reading a masters in belfast. We are living together in fact.
We were planning to marry in the summer and then go to the USA in the autmn once both our masters courses are finished but now having done bit of research into the whole green card thing we are wondering if we should move it up a bit and marry sooner so we can file immediately.
I have some questions though. Can my fiancee utilise a DCF if she is here in the uk on a limited visa? Is it ok to also apply for her status in the uk to be changed at the same time ie from student to FLR? Is a DCF filing for green card the best way to proceed?
How long does the DCF take and what does it entail?

It is best to contact the Embassy and ask if they will accept a petition
filed directly while your wife is on student status.

You have to be somewhat careful about your forms. Since you will have to
send your passports away when filing for FLR (unless you go in person to
a public enquiry office; unfortumately there doesn't appear to be one in
Belfast) make sure you allow enough time for them to be returned since
they will be needed on the day of your US immigration interview
(assuming DCF is possible)
DCF should take 3-6 months
Though some things have changed since this page was written it will
serve as a general guide to DCF and is the one my wife and I used when
we did DCF in 2001
