advanced parole
 
Hi

I have a question about advanced parole.

How secure is it? I mean my wife has k1 and has applied for change of
status almost 15 mo ago but if she leaves the country with advanced
parole and wants to come back, what's the chances of not letting her
re-entry?

her case is behind fingerprinting. she has done two but non has been
successful and that has delayed her case.
So I wante to know if she uses advanced parole, does that delay her
application process, knowing that her security check has passed.

also, what's the chances of not letting her in again?

Any feedbacks is greatly appreciated.

If her AP is still valid (it's good for 1 year), she can use it to return to the USA before it expires. Many people on this forum have traveled using AP and have not had a problem. Problems arise when something goes wrong while the alien is outside the USA, for example, for some reason the I-485 is denied while she's outside the USA. If that happens, her AP is no longer valid. Or she remains outside the USA after her AP expires, in that case she can't return to the USA. Otherwise, normal use of the AP shouldn't pose any problems.

A person who is paroled into the USA, however, has a bit different status than one who is here on the K-1 (without having left the USA). Do a search on this forum for posts by Folinskyinla regarding this topic, he's made several references that "paroled" status is different than "entry" status.

Only US citizens have the right to enter the US... for everyone else, there is *never* a guarantee of being allowed in... this is true whether the person has a valid visa, a valid GC, or a valid AP. In all cases, since there are only two possible outcomes - being let in or not - there is always a 50/50 chance.

If she has the advance parole, she will be alright getting in. However,
be prepared that there will be a waiting time at the airport for the
officer to verify the advance parole.

Base on my personal experience, I waited for over an hour in an office
at Houston Airport for the officer to spend 10 secs to look at my AP to
make sure that its real and stamp on the AP. If you have another
domestic flight to catch after you enter US, make sure you have plenty
of time in between as there is no telling how long you need to wait for
them to just spend less than a minute to look at the AP. So the problem
is not about AP document that I have but waiting for the officer to
verify that its real and stamped it. I hope that helps, I can understand

Even though there are only two choices, IMHO it's inaccurate to characterize it as a 50/50 chance. Far more people are let in with AP than not let in. It's probably closer to a 99%/1% ratio... not that I have any statistics but just from seeing all the reports of people using their AP successfully.

To the OP: my husband used AP successfully several times while his AOS was pending. We used it to go on vacation and to visit relatives/friends. We used it at airports as well as at the Canada/US land crossing. If your wife is not inadmissible and the AP is valid, there should not be any problems. However, as Rene noted, being "paroled" in on AP puts your wife in a different status than never having left at all. IIRC the effect is that of being legally outside the US even while being physically *inside* the US -- making her easier to deport.

Also I don't think using AP would delay her application process.
