Advance Parole Questions?? Please Help.

Hi everyone,
I have a question regarding Advance Parole. My wife, who is from Canada originally,
recently received her photo EAD at the Philadelphia INS offices. Our interview is not
until July 2002, however, and we'd like to visit her family in Canada over Christmas
this December, so I believe we need to apply for advance parole for her.
The process seems simple enough, fill out the form, send it with a $100 money order
to the Philly INS office, and she gets hopefully approved. Are there any possible
problems or complications that may arise with this, or any chance she'll get held up
at the border leaving the US or getting back in? We want to make sure we have all the
correct documentation so we can legally exit and re-enter the country without
problem. Could anyone give me some pointers or advise me if there's anything we might
not be aware of?

You only need to think about this if your wife has been out of status for > six
months. As a Canadian this is highly unlikely and anyway, Philly should pick that up
and refuse to issue the AP. Other than that, get the AP and have a great trip!

My husband entered the US on May 12. He applied for and received the AP in the middle of August. The AP was single entry and on the application he stated that he wished to use the AP during the first week of September. But the WTC attacks happened and we put off the trip. He's been in the country almost 6 months now and still needs to go back to Canada to get his belongings. Should he send in another AP application? Or just not risk crossing the border?

If the AP is still valid, it's fine to use it. Usually they still issue single-use
APs with an expiry of a year anyway. If you look at it you'll notice that the
intended date of departure isn't mentioned anywhere on it.
