Hi,

I am wondering when do I have to make the decision whether I want to do Adjustmen of
Status or Consular Processing. I heard this decision can be made before I-140 filing.
However, I saw ETA750 form (labor certificate) asking the same question.

If I indicate I want to do AOS on LC application, can I change my mind later on when
filing I-140?

Yes, you can change your mind easily from whatever was indicated on the LC
application. I have wondered why that question is on the ETA 750. It does not seem to
matter a bit.

And on Form I-140, if you indicate consular processing, you can change your mind
easily to adjustment of status.

But if you indicate adjustment of status, you cannot change your mind easily to
consular processing.

It may take an extra year or so beyond the I-140 approval if you change your mind
and insist on consular processing after having indicated adjustment of status on
the I-140.
