I finally got my head out of my ass from dealing with my wife's death and am
starting to get things together to re-submit my I-485, along with I-360 (petition
for widower).

It is unclear which accompanying form I must submit with the I-485. Obviously G-325a
(bio) and I-693 (medical).

I'm supposed to send in the I-864 (sponsor), but given my wife is dead, she can't
sponsor me, how does this work?

What about I-130 (petition for alien relative)? Again, obviously Linda cant' fill
that one out. Is it taken care of by the I-360?

I've been reading the instructions on the forms and on the website, and it's really
totally unclear. Even in the I-485 page, in filing for special cases, the widow/er is
not an option with explanations...

Thanks for any and all help/information.

It appears that you do not have to file an I-864, you are exempt...see this URL:
http://www.ins.usdoj.gov/graphics/pu...ts/afffact.htm (do a "find"
for the word "widow" and it will take you to that sentence)

I do not think that you will need the I-130, the I-360 instructions state that you
can file the I-485 with it.

I would get everything filled out and go to my local INS office and confirm with them
that you had everything in order and file it in person IF they allow it. I would
additionally check with them on filing for EAD at the same time, since this will
technically be a whole new AOS. You will probably need ADIT pictures, also, and
another $25 fingerprinting fee. I think that you would file under category (a) on the
I-485 but you need to confirm this with your local INS office.

alvena I am not a lawyer and this is not legal advice, this information is posted for
the purpose of discussion.
