I have a friend from eastern Europe who married an American man and is
here in the USA. She has applied for a temporary green card. It
turns out that her husband is quite abusive. She will have to leave
him but would like to remain in the USA. She believes that her
temporary green card will be good for one year, even if she leaves
him, and by then she plans to be employed in a skilled position, and
thinks that her future employer will be able to request that her green
card gets renewed when it expires in one year. Is this correct?
Would she be required to report her change in marital status to the
INS if she gets divorced? She originally came under a fiance visa;
can she remain in the USA if she gets a divorce? Thanks.

There are cases where she can remain ... but she really should talk with
an immigration attorney for the specific dates and details.

Can she document the abuse? If so, an "abused spouse" green card is
what she needs to apply for. She she use an immigration attorney to
prepare the petition, because having and presenting the right evidence
is the key to obtaining approval.
