does somebody know if the i-130 was denied it will cause the big problem on i-485? if i still stay here legally? i came to U.S on k3 visa and my visa will expire in feb. 2006.i am in CA.i have repplied my i-130 with my i-485 application toghter in DEC.6 2004 but untill now i haven't received any receipt.do you think there is something wrong with it?I am so worried.thank you for helping me !

I am a K-3 visa holder, who got denied I-130 petition last month. And we've heard that after denial decision made, my current K-3 visa would be expired in 30 days if my I-130 case is not reopened. So, we decided to send a motion to reopen the original I-130 petition, and I got a letter from USCIS that they reopened my case two days ago. (my denial was because of failure to change my address. They thought we did abandonment, but it was not our fault b/c we tried to change our address and we had some documents that could be evidence.)
I and my husband visited immigration lawyer last month, and she recommended us to send a new I-130 and I-485 as well as I-131 to chicago service center, but we got a letter from USCIS right before my medical exam. So, we will go through the old I-130 case and try to get a IR-1 visa in south korea.
I think that because you already filed another I-130 with I-485, the best and fasted thing you can do is just to wait for receipt from chicago. I recommend you to call chicago office to check your petition status.
