90-day Temporary EAD for K-1 (before marriage)?

My fiancee just went to the San Jose INS office to get a temporary EAD to use before
we are married and apply for a real (1-year) EAD. They said it is not possible, and
that we must be married to get any kind of EAD.

Is this right?

I've read in this newsgroup that lots of people get a temporary EAD without yet being
married. If our local INS office won't give it to us, what are our other options?

They are correct that you can't apply for the one year EAD (you can only do that with
or after the AOS application); they are incorrect that you can't get a 90 day EAD.
However, not all INS offices will give this to you although more have started to do
so so perhaps there was an official edict to do it. If you want to pursue it with
them, you need to file in category
(a) (6).

Sure, all you have to do is move... INS wants you to visit the office tied to
where you live.

Actually for the 90 day EAD, some people have had success with offices other than
their local one - notably offices in the same region as POEs that don't give it out
but direct people to the INS office.
