Hello everyone,
I have noticed in a number of postings that petitioners filing a 129F have included
copies of their finace(e)'s birth certificate and/or passport in the packet sent to
INS. Nowhere in the FAQ's in the INS website or in the filing instructions for the
129F can I find any mention of including either of these documents. Can anyone shed
any light on whether or not they are really required in the initial filing?
Thanks for any and all help.
Alan

I personally dont see the point in sending those documents, especially a copy of the
passport. You are right, the INS doesnt ask for them. They get examined at the K1
interview itself, when the benificiary takes a load of paperwork with him/her. You
must show the originals to the officer, which they immediately give back, and also
supply copies which they keep. I got my K1 visa with no problems whatsoever, and we
didnt put any copies of my birth cert or passport in the original petition. I hope
this helps Jacqueline

The US fiance's birth certificate (copy) is required as proof of citizenship. I
thought the instructions on the I-129F form were very clear on this matter. The
foreign fiancee's birth certificate is not a required item, however some people
include that as well. If you do that, make sure that it is translated in English if
it is a foreign (non-english) document.

We didn't put a copy of my birth certificate in and were approved no problem.(i am
the UK half)
On the passport side were they perhaps, like we did, actually including copies of
passport pages to show the customs stamp? I included those along with my boarding
passes as evidence of meeting. I didn't copy the back page or anything, just the
pages with the actual stamps on.

The only reason a birth certificate is included with the I-129F at all is to prove
the PETITIONER's US Citizenship. Other items can be used for this, including US
Passport and US Naturalization Cert.
No BC is necessary from the BENEFICIARY. Period. (It will be needed, translated,
later on in the process, but not to be sent with the I-129F.)
