Hello Newsgroup friends,

I have posted a couple times here inquiring about EAD application to NYC INS as well as
I-130 and I-485. NYC INS received my application package on November 30, 2000, which fact
I confirmed by checking FedEx tracking information. It's been 63 days, and still, checks
are not cashed yet, not to mention getting no receipt or NOA from the office. I think
someone posted previously that NYC INS is about 10 weeks late in opening new applications.
Could this be the reason my application is not getting any attention, and maybe sitting in
a box with a bunch of other new applications?

My current EAD which I was granted through F1 Post-Completion Optional Practical Training
is about to expire in a couple weeks. I am planning to take leave of absence temporarily
until I receive the new EAD, because neither I myself nor my company's legal department
would not want to get into any trouble by working with expired EAD. (Is this what people
with EAD gap usually do???)

I am patiently waiting for the response from NYC INS, but honestly, I can't help being
concerned about having too long a gap between the old and new EADs' authorized dates.
Previously there was a message on this board about "90 days rule". I don't remember
exactly, but I think it said "90 days" can be counted starting from the date either on the
receipt from the cashed check, or the one on the notice NYC INS sends out. My situation is
a little different because I didn't receive ANYTHING.

Could anyone please let me know if
(1) I should keep waiting for any kind of receipt or notice, and then count 90 days
according to the date written, or
(2) can I go to their office after the 90th day from November 30, 2000, which is the date
NYC INS received the application by FedEx?

Any suggestion will be greatly appreciated!!! Thank you all so much for reading my
message. :o)

Hello Newsgroup friends,

If you have the time, I would get a printout of the Fedex receipt and armed with that I
would go to the third floor of the NYC INS office at 26 Federal Plaza and inquire about
the missing AOS receipt and EAD appointment.

It may come down to the fact that you will have to re-submit all of the paperwork again
since your checks have not been cashed.
