Gov't should only get 1 chance to prove their case. I prefer the US system and the inability of prosecution to appeal.

OK, I will dumb this down as much as I can for you: It is not the prosecution that screwed up, but the Judge. In other words, the prosecution may have performed perfectly, but the Judge got the law wrong which allowed the otherwise "guilty" person to go free.

Would you hold the same view if an innocent person was jailed because of a Judge's error?
