Cars stopped randomly for search
 

Police in London, ont. near where I live, are suspecting a "suspicious" package and are randomly strip-searching vehicles and their occupants for it.

What are people's rights in this; ie can they say "No thank you. I'm afraid if you'd like to search my car you'll need a warrant, and i'll be on my way" and drive away. ?

AFAIK warrantless search is illegal by the charter of rights and freedoms.

If I mentioned this on FB or in person, most Canadians would take offense that I don't have faith in that what the police says is right and that I should just shut up and comply... Typical attitude IMO. "It is what it is".

Legally they need a warrant to search the trunk and inside of the vehicle.
If you give them consent to search then no warrant is needed.
Strip searching Im pretty sure they would need a warrant however a pat down can be done without one.
Given the circumstances and this DOESNT happen on an everyday basis would you prefer to assist the Police are be the I know my rights etc etc.
One day you will possibly need the Police to assist you so would you be happy if they turned around and said Thats not our jurisdiction or problem.

I know what you mean, I just want to know what my rights are, in case I ever need to invoke them. You see, the school system doesn't teach us these things ;)

It would probably be easier to assist the police and not arouse suspicion, etc. As you say if you consent no warrant is required.

I know your age, and I suppose the average age of us lot is I don't know 45ish? So nearly three times as old.... I do wonder what you'll think when you reach our collective age and look back at what you posted. It all hangs around somewhere in the ether...

What's that to do with it. I'd like to know my rights, in case I ever need to invoke them. Example: I am on way to airport and cannot be bothered for a random search else I miss my flight.

I think you might suddenly find your taillight is broken, giving them cause to stop you anyway,ensuring you very actually do miss your flight...

However "random" searches are certainly the thin end of the constitutional wedge.

Unless you are black or swarthy looking the plod will probably leave you alone anyway.
