Copy of wills in Malaysia

My British father died in Malaysia where he lived. The executor of his will says we cannot see a copy of the will, does anyone know if this is correct? It does seem odd.

Re: Copy of wills in Malaysia

Are you talking about a UK will or a Malaysian one?

At least you know the executor. Did s/he contact you? How do you know who s/he is? An executor would indicate there IS a will, which is good. If they contacted you then you are likely identified in the will, which IS good. That means he didn't die "intestate" (without a will).

Here's an article about Wills in Malaysia worth reading. Not a lot of legal mumbo.

If the executor is resistant to explaining the contents of the will then you may have to contact a local lawyer trained in challenges to wills. Factors that will be important is whether he remarried, has local children, etc.

His assets, if any, in Britain need to be separately covered by a UK will.

There are several lawyers listed on the internet in Malaysia that deal with wills and estate planning...they might be able to help. Ask them specifically if it matters what state will handle the matter and if they have a lawyer in that city/state.

Also the British embassy might be able to give you some guidance.

Good luck.
